Technically called section 21 agreements, these are agreements signed by two people in a relationship for the purpose of determining how their property is to be divided if the relationship ends.
In New Zealand, we often call this a ‘contracting out agreement’ because they have the effect of ‘contracting out’ of the Property (Relationships) Act 1976 (“PRA”).
So, do you need one? This will depend on the circumstances of your relationship; however, it is useful to first have a basic understanding of the PRA and what it could mean for you if you and your spouse or partner break up.
